Germany Caught Between ICC Obligations and Israel Ties as Merz Vows Safe Visit for Netanyahu
Following a triumphant election campaign, Friedrich Merz, leader of Germany’s conservative Christian Democrats (CDU), addressed journalists in Berlin, expressing confidence as he prepares to take office as chancellor. Merz is expected to lead a coalition government alongside the center-left Social Democrats (SPD).
However, his recent remarks regarding Israeli Prime Minister Benjamin Netanyahu have sparked controversy. During a phone call, Merz assured Netanyahu that Germany would find “ways and means” to facilitate his visit without the risk of arrest. This statement comes despite an arrest warrant issued by the International Criminal Court (ICC) against Netanyahu for alleged war crimes in Gaza.
Germany, a staunch supporter of the ICC and one of its 125 member states, is legally obligated to enforce the warrant if Netanyahu enters its territory. SPD foreign policy expert Nils Schmid reaffirmed Germany’s commitment to ICC procedures while hinting at diplomatic solutions to maintain ties with Israel.
The outgoing government under Chancellor Olaf Scholz has carefully navigated this sensitive issue, balancing its historical responsibility toward Israel with adherence to international law. Legal scholars, such as Professor Kai Ambos, stress that Germany’s judiciary is bound to execute ICC warrants, warning that political interference could undermine judicial independence.
Merz’s position aligns with other right-wing leaders, including Hungary’s Viktor Orbán, who openly defied the ICC by welcoming Netanyahu. As Germany transitions to new leadership, Merz’s handling of the issue will test the nation’s stance on international justice and its unwavering support for Israel.
