The police charged Kelvin who lives in Giri Gwagwalada, FCT with attempt to commit offence and theft.
The Judge, Malam Abdullahi Abdulkarim, sentenced Kelvin after he pleaded guilty to the charge and begged for leniency.
Abdulkarim gave the convict an option to pay a fine of N5,000 or serve a jail term of six weeks.
“I considered the fact that he is a first time offender. He has shown remorse for the crime committed and has admitted to the offence without labouring the court to go through trial.
”The hard conditionin the country should not be an excuse for the convict to commit an offence,” he said.
The convict had earlier pleaded with the court for mercy, adding that he was a married man that the situation in the country pushed him into committing the offence.
Earlier, the Prosecution Counsel, Mr Abdullahi Tanko told the court that the complainant, Mr Emmanuel Danjuma of Gwako village, Gwagwalada reported the matter at the police station on March 18.
Tanko said that the convict criminally trespassed into the complainant’s filing station site located at Gwako village Gwagwalada and attempted to break into a container.
He said that the said container contained bags of cement and other valuables.
The prosecutor said that the offence contravened the provision of Sections 97 and 287 of the Penal Code. (www.naija247news.com)
